Beyond Tickets AG – General Terms and Conditions
1. General Provisions
1.1 Subject Matter and Definitions
Beyond Tickets AG (Beyond Tickets) operates an online mediation platform for events, accessible via web, mobile apps, and other digital applications (Platform). The platform allows tickets for events and activities of all kinds to be sold and purchased, and various services to be offered and booked.
The following definitions apply:
Organizers are natural and legal persons who offer tickets for events, activities, or similar occurrences on the platform for a fee or free of charge (Tickets). This also specifically includes hosting partners. The organizers act exclusively in their own name and at their own expense and risk.
Events are all occurrences that are offered by organizers on the platform for a fee or free of charge and for which tickets can be obtained for a fee or free of charge. This includes in particular events, festivities, performances, and similar activities.
Service Providers are natural and legal persons who offer various services on the platform for a fee or free of charge. The service providers act exclusively in their own name and at their own expense and risk.
Services are all offerings by service providers that can be booked via the platform for a fee or free of charge. This includes in particular services and goods of various kinds.
Orderers are natural and legal persons who purchase or book tickets or services via the platform for a fee or free of charge. If an orderer purchases multiple tickets, all natural and legal persons who receive a ticket from the orderer are also considered orderers.
Orders are transactions for the free or paid acquisition of tickets or the paid or free booking of services by orderers.
Customer(s) are organizers, service providers, and orderers. Customers need an individual platform account (Account) to use the platform.
1.2 Beyond Tickets is exclusively a Mediator
Beyond Tickets is never, unless expressly agreed otherwise and/or marked, itself an organizer, service provider, or orderer of the events or services offered on the platform. Beyond Tickets acts solely as the operator of the platform and generates tickets on behalf of the organizers.
The responsibility for services related to tickets and services offered via the platform, as well as orders, lies solely with the respective organizer and/or service provider. The organizers and service providers always act in their own name and at their own expense and risk on the platform. The organizers and service providers are solely and exclusively responsible for the execution of events or the provision of services.
1.3 Scope of Application of AGB and Other General Terms and Conditions
For any use and any type of use of the platform by customers, only the General Terms and Conditions of Beyond Tickets (AGB) apply.
The AGB become an integral part of the contract between Beyond Tickets and the respective customer.
Chapters 1 and 6 through 9 of these AGB apply to all customers. Additional provisions apply to orderers according to Chapter 2, to organizers according to Chapter 3 and 5, and to the organizers according to Chapter 4 and 5.
If the organizers and service providers have their own General Terms and Conditions, which particularly apply to the execution and visitation of events or the processing of services, those General Terms and Conditions apply in addition to the current AGB of Beyond Tickets.
The General Terms and Conditions of the organizers and service providers take precedence in the contractual relationship between the orderers on one side and the organizers or service providers in conflict cases concerning the AGB of Beyond Tickets. Orderers are obliged to inform themselves of the applicable General Terms and Conditions of the respective organizer or service provider and to comply with them. Violations of these General Terms and Conditions may lead to denial of access or exclusion from the event, without any claims for reimbursement or compensation. Beyond Tickets assumes no liability for content, requirements, or consequences arising from the General Terms and Conditions of the organizer or the venue/service provider. General Terms and Conditions of organizers and service providers never apply against Beyond Tickets, and only the AGB of Beyond Tickets are valid.
1.4 Place of Fulfillment
The place of fulfillment for all services from Beyond Tickets, including the generation of tickets, is the registered office of Beyond Tickets.
1.5 Communication by Beyond Tickets
Beyond Tickets primarily communicates electronically via email.
1.6 Currency of Customer Data
Customers are obliged to use correct and up-to-date data, information, and contact details, particularly a valid email address through which communications from Beyond Tickets can be received. Customers are solely responsible for receiving and acknowledging communications from Beyond Tickets to the email address used by the customer.
1.7 Responsibility for Used Electronic Devices by Customers
Customers are solely responsible for ensuring that the electronic devices they use are functional and that all necessary software updates are installed. This particularly applies to showing tickets by orderers as well as checking tickets by organizers at the entrance to an event.
1.8 Maintenance and Support
Beyond Tickets is entitled to take the platform or parts thereof out of operation at any time for maintenance, improvement, or technical adjustments. Planned maintenance work will be announced in advance on the platform and/or accounts whenever possible.
Beyond Tickets provides customers with support services for the platform to the extent deemed appropriate and necessary by Beyond Tickets. There is no entitlement to a specific type, a specific scope, or a specific response time of support, unless explicitly agreed upon in writing.
Beyond Tickets is not liable for damages arising from temporary unavailability of the platform, delays in support, or technical disruptions.
1.9 Violation of these AGB
Beyond Tickets reserves the right, in case of a violation of one or more provisions, in particular Section 2.3, to temporarily suspend or permanently delete the account. This sanction does not have to be announced in advance by Beyond Tickets.
2. Specific Provisions for Orderers
2.1 Order and Use
2.1.1 Conclusion of Contract
Orders are completed when the orderer receives a corresponding confirmation (acceptance) of the order from Beyond Tickets (on behalf of and in the name of the organizer or service provider).
With an order, a direct contractual relationship arises between the orderer and the organizer or service provider. The orderer acknowledges that only rights and obligations between the orderer and the organizer or service provider arise from such a relationship. Only rights and obligations between Beyond Tickets and the orderer arise insofar as the order concerns direct services of Beyond Tickets.
2.1.2 Fees and Payment
In addition to the price of tickets or services, service fees, processing fees, and other event-specific fees may apply. These will be displayed to the orderer during the ordering process.
The payment methods offered on the platform during the order process may depend on the specifications of an organizer or service provider. Beyond Tickets, the organizers, and the service providers are not obliged to offer specific payment methods.
2.1.3 Delivery in Electronic Form
The delivery of purchased tickets occurs exclusively as an electronic ticket, so-called E-tickets, in Portable Document Format (PDF) via email or another electronic form. Confirmations of an order for services also occur electronically (Confirmation). The ticket or the confirmation will only be delivered to the orderer after payment.
The orderer is solely responsible for ensuring that they have received their ordered ticket(s) or confirmation and can present ticket(s) at an event, particularly in the context of any entry control. This means, among other things, that the orderer must have a functional mobile device (e.g., smartphone) and have installed the necessary software and security updates. The orderer is free to print their E-ticket(s) physically. Should the customer present a ticket in physical form, the orderer must ensure that the ticket remains legible and undamaged.
2.1.4 Responsibility for Information Provided During the Ordering Process and Verification Duty of Orderers
The orderer bears the risk for providing correct information in the ordering process, particularly regarding the selection of the service or event, location, date, and seat. In the case of personalized tickets according to Section 2.1.7, the orderer is responsible for providing correct details and information for all persons for whom they are purchasing tickets.
The orderer is obliged to check the order immediately upon receipt. Particularly for personalized tickets according to Section 2.1.7, the orderer must check whether the provided names and information are correct. Discrepancies or errors must be reported promptly, but no later than five (5) business days after receipt, and always before the event, in writing to the support of Beyond Tickets according to Section 2.6. If no report is made by the orderer within this period, no adjustments can be made by Beyond Tickets.
2.1.5 Modification or Editing of Tickets by Orderers
Copying, modifying, or imitating tickets is strictly prohibited. Tampered tickets become invalid, and access to the event may be denied. Orderers have no claim to a refund of the price.
2.1.6 Technical Problems and Faulty Tickets
Beyond Tickets is not liable for technical problems that are due to external factors such as defective mobile devices, incompatible software, or a lack of internet connection of the orderer.
Physically printed tickets with unreadable barcodes or otherwise damaged physically printed tickets will not be replaced and are considered invalid.
The orderer is obliged to report technical problems with tickets immediately to Beyond Tickets. Following receipt of the report, Beyond Tickets may create a replacement for tickets if the ticket order has been demonstrably made and the technical problems were not caused by improper handling or alteration by the orderer.
2.1.7 Personalized E-Tickets and Access Credential to Events
Organizers are entitled to personalize tickets (Personalized Tickets). If an organizer personalizes tickets for an event, only the person named on the respective ticket is entitled to attend the event.
It is solely at the discretion of the organizers to request a valid age verification from the orderer for access to an event. Lack of age verification may lead to denial of access. For personalized tickets, only the person named on the ticket is allowed to enter the event. If the details on the ticket do not match the identity of the person requesting entry, access may be denied. This applies even if the name on the ticket is not legible. In these cases, the orderer has no claim for a refund.
The orderers are obliged to comply with health and safety regulations and all relevant safety-related requirements set by the organizers. This includes consent to entry and security checks serving the safety of all other attendees. Organizers reserve the right to deny access or exclude orderers from the event if certain circumstances require it. In addition, access may be restricted or denied for orderers who arrive late to the event, depending on the organizers' specifications.
2.2 Cancellation and Refund
2.2.1 Principle
Beyond Tickets assumes no responsibility for the execution, changes, or cancellation of events or services. Concerns or claims directly or indirectly related to the event or service must be addressed exclusively to the respective organizer or service provider.
After the conclusion of an order, cancellations, returns, or refunds for an order placed through Beyond Tickets are excluded. This applies regardless of the reason for the orderer’s inability to attend the event or service, such as illness, unforeseen circumstances, or other personal obstacles of the orderer. Deviating provisions from organizers or service providers take precedence.
Each order is subject to the organizer's or service provider's right to change or vary the program or course of the event if special circumstances or events beyond the control of the organizer or service provider require this. Such changes do not establish a claim for exchange or modification of the order, refund of the purchase price, or any other compensations.
2.2.2 Postponement or Relocation of an Event or Service
In the event of a postponement of the event/service date or a relocation of the event/service venue, the ticket or confirmation remains valid for the new date and/or location. The organizer or service provider independently decides whether refunds or rebooking are offered under such circumstances. Beyond Tickets assumes no responsibility for these decisions.
2.2.3 Cancellation of Events or Services
If an event or service must be canceled due to force majeure (e.g., natural disaster, pandemic, epidemic, government orders, etc.), the contract between the orderer and the organizer or service provider remains in force. The organizer or service provider decides in such cases on the further course of action, including possible refunds or rescheduling. Beyond Tickets is not liable for financial or other damages resulting from the cancellation of an event or service due to force majeure.
If the organizer or service provider decides to cancel an event or service without replacement, the responsibility for possible refunds lies solely with the respective organizer or service provider.
2.2.4 Refund
The refund of orders is solely the responsibility of the organizer or service provider. A refund by Beyond Tickets is excluded. The orderer will be informed about the refund process and the necessary steps via email. Claims can only be made within the periods specified by the organizer or service provider.
If errors regarding the price indication according to Section 3.1 or 4.1 are discovered, Beyond Tickets will notify affected orderers by email. The orderers then have the opportunity to confirm or cancel the order at the correct price. In the case of a cancellation, the entire price will be refunded.
2.3 Transfer and Resale of Tickets Purchased via the Platform
The commercial transfer or resale of tickets is prohibited. The tickets are intended exclusively for the personal use of the orderer. A violation of this provision may lead to the cancellation of the tickets without a refund, compensation, or liability from Beyond Tickets.
2.4 Maximum Number of Tickets
Organizers may set a maximum number of tickets that can be purchased per orderer for each event at their discretion. The maximum number is visible during the ordering process. Beyond Tickets expressly reserves the right to declare and cancel tickets invalid, acquired by the same orderer exceeding this maximum number, without prior notice. This also includes tickets purchased by the same natural or legal person via different accounts of the orderer on the platform. The cancellation and invalidation of these tickets by Beyond Tickets takes place without refund, compensation, or liability from Beyond Tickets.
2.5 Allianz Ticket Protection
Orderers may purchase the ticket protection from Allianz Assistance as an optional add-on product during the ticket purchase process for an event. The ticket protection covers various risks as per the General Insurance Conditions (AVB) of the ticket protection. The ticket protection is offered directly and exclusively by Allianz (AWP P&C S.A., Saint-Ouen (Paris), branch in Wallisellen (Switzerland)). Beyond Tickets is solely a mediator of this optional add-on product. Beyond Tickets assumes no liability or responsibility for claims in or related to the ticket protection. The current general insurance conditions of Allianz, which are displayed to you during the checkout process when concluding the ticket insurance, apply. Claims are to be directed to Allianz at claims.ch@allianz.com.
2.6 Inquiries from Orderers
Inquiries from orderers regarding the platform must be submitted to Beyond Tickets exclusively via email
(support@beyond-tickets.com). Inquiries will be answered within an appropriate period.
For inquiries about the event or service itself, the orderer must contact the respective organizer or service provider directly. Beyond Tickets does not answer inquiries that are to be directed to an organizer or service provider.
3. Specific Provisions for Organizers
3.1 Conclusion of Contract
The contract between the organizer and Beyond Tickets comes into effect when the organizer receives a corresponding confirmation (acceptance) from Beyond Tickets after the activation of an event on the platform.
The contract between the organizer and the respective orderer comes into effect when the orderer receives a corresponding confirmation (acceptance) of the order from Beyond Tickets (on behalf of and in the name of the organizer). With the order, a direct contractual relationship arises between the orderer and the organizer. Beyond Tickets is not part of this contractual relationship and is solely a mediator for the organizer's services.
3.2 Fees and Refund
A service fee is charged for each ordered ticket for an event. Individual agreements between the organizers and Beyond Tickets remain reserved. The service fee is added to the purchase price and borne by the ticket buyers.
Beyond Tickets is under no circumstances obliged to refund the service fees. A refund due to postponement or relocation according to Section 2.2.2 occurs, if approved by the organizer, in the amount of the net event price. The service fee is excluded from the refund and remains with Beyond Tickets.
3.3 Advertising and Content on the Tickets
The organizers are fully and solely responsible for the content on the generated tickets provided by the organizers and/or printed on the tickets. Beyond Tickets assumes no liability for its accuracy or completeness.
The organizers agree to indemnify Beyond Tickets in full if Beyond Tickets incurs damage due to content on the tickets, for which the organizers bear full responsibility. The same applies to advertising that is printed on the tickets by the organizers.
3.4 Fair Use Policy for Free Tickets
Organizers may create free tickets (Free Tickets) for events within reasonable limits. The number of generatable free tickets is limited to 1,000 free tickets per organizer per calendar year. Individual agreements between an organizer and Beyond Tickets remain reserved. The creation of free tickets is exempt from maintenance and support according to Section 1.8.
Beyond Tickets reserves the right to restrict or suspend the account of an organizer if free tickets are created to an unreasonable extent. If the organizer exceeds the limit of free tickets set forth in this section per calendar year, Beyond Tickets may charge an additional fee of CHF 0.20 for each ticket created that exceeds the limit.
3.5 Test Tickets
Beyond Tickets has the right to create two (2) tickets per event free of charge for checking software and processes, provided that the maximum available number of tickets for the event is not exceeded.
3.6 Access Management at an Event
Beyond Tickets provides the scanning software required for entry to an event. Beyond Tickets and an organizer may make further individual agreements for additional services related to personnel and technology.
Beyond Tickets is not liable for technical problems that are due to external factors such as defective mobile devices, incompatible software, or a lack of internet connection.
Organizers are obliged to report technical problems with tickets, QR codes, or other digital access credentials immediately to Beyond Tickets.
4. Specific Provisions for Service Providers
4.1 Conclusion of Contract
The contract between the service provider and Beyond Tickets comes into effect when the service provider receives a corresponding confirmation (acceptance) from Beyond Tickets after the activation of a service on the platform.
The contract between the service provider and the respective orderer comes into effect when the orderer receives a corresponding confirmation (acceptance) of the order from Beyond Tickets (on behalf of and in the name of the service provider). With the order, a direct contractual relationship arises between the orderer and the service provider. Beyond Tickets is not part of this contractual relationship and is solely a mediator for the service provider's services.
4.2 Fees and Refund
A service provider fee is charged for each booking of a ticket. Individual agreements between the service providers and Beyond Tickets remain reserved.
Beyond Tickets is under no circumstances obliged to refund the service provider fees. A refund due to postponement or relocation according to Section 2.2.2 occurs, if approved by the service provider, in the amount of the net service price. The service provider fee is excluded from the refund and remains with Beyond Tickets.
4.3 Responsibility for Correct Information
The service providers bear sole responsibility for and in connection with the service. Beyond Tickets makes no warranty for the accuracy or completeness of information communicated by the service providers.
The service providers are solely responsible for damages incurred by Beyond Tickets because information for services was incorrect or incomplete.
5. Joint Provisions for Organizers and Service Providers
5.1 Operation of the Platform
Beyond Tickets provides the organizers and service providers with the platform and the associated services, particularly remote access, in accordance with industry standards and strives for the best possible availability and access. However, Beyond Tickets does not guarantee uninterrupted availability of the platform or the associated services. Beyond Tickets reserves the right to temporarily restrict the platform as necessary.
5.2 Use of the Platform
By using the platform, the organizers and service providers accept that Beyond Tickets does not assume any guarantees of any kind, including, but not limited to, uninterrupted availability of the platform, marketability or suitability for a particular purpose, or freedom from errors or outages.
5.3 Communication by Beyond Tickets and Access to Information
Invoicing, reports, or other communications between Beyond Tickets and the organizers and service providers occur electronically via email or digitally through the platform.
The organizers and service providers have access to information about the status of their events as long as their account is active. Beyond Tickets provides the organizers and service providers with up to thirty (30) calendar days after an organizer or service provider has deleted their account or their account has been blocked or deleted by Beyond Tickets to download stored customer data. Thereafter, Beyond Tickets may delete the account of an organizer or service provider completely.
5.4 Responsibility for Events and Services
The organizers and service providers bear sole responsibility for and in connection with the execution of an event or service, as well as for the legality, accuracy, completeness, and currency of information and materials made accessible or communicated by the organizers or service providers to the orderers or Beyond Tickets.
Beyond Tickets makes no warranty for the accuracy or completeness of information made accessible by the organizers and service providers on the platform. The organizers and service providers are solely responsible for this.
The organizers and service providers bear sole responsibility for damages incurred by Beyond Tickets because information for events or services was incorrect or incomplete.
The organizers and service providers are solely responsible for VAT accounting.
5.5 Withdrawal of Usage Rights on the Platform
Beyond Tickets is entitled to immediately ban the use of the platform by an organizer or service provider if Beyond Tickets has justifiable reason to believe that the affected organizer or service provider has issued instructions that cannot be executed. This measure does not have to be announced in advance by Beyond Tickets.
5.6 Inquiries from Organizers and Service Providers
Inquiries from organizers and service providers regarding the platform must be submitted to Beyond Tickets exclusively via email (support@beyond-tickets.com). Inquiries will be answered within an appropriate period.
5.7 Marketing Tracking
Beyond Tickets offers the organizers and service providers support in establishing marketing tracking (e.g., pixel tracking) for an additional fee.
6. Liability
Beyond Tickets is not liable for slight and moderate negligence, including resulting indirect damages.
Beyond Tickets exclusively operates the platform and assumes no liability for losses, damages, or injuries of any kind arising before, during, after, or otherwise in connection with an event and/or service. This includes among other things the loss, damage or theft of personal belongings. Events or services are solely the responsibility of the respective organizer or service provider.
7. Intellectual Property and Other Rights
7.1 Rights to the Platform
All rights, titles, and claims to the platform, including, but not limited to, the underlying software, source code, design, content, trademarks, logos, texts, images, databases, and other elements, remain the exclusive property of Beyond Tickets or its licensors. This includes all intellectual property rights, including copyrights, trademark rights, patent rights, and design rights.
7.2 Granting of a Usage Right
Customers are granted a limited, non-exclusive, non-transferable, non-sublicensable, and revocable right to use the platform in accordance with these AGB and exclusively for the intended purposes.
7.3 Prohibited Actions
Customers are prohibited from, without prior written consent from Beyond Tickets (i) copying, modifying, adapting, reverse engineering, decompiling, or otherwise attempting to decipher the source code of the platform, unless permitted by mandatory Swiss law, (ii) using the platform for illegal purposes or in a manner that violates the rights of Beyond Tickets or third parties, or (iii) using automated systems (e.g., bots, scraping tools) to access the platform or extract content.
7.4 Protection of Rights
Customers acknowledge that the platform is protected by copyright, trademark, patent, and other protective rights under Swiss law. Any unauthorized use, distribution, or infringement of these rights is prohibited and may result in civil and criminal consequences.
7.5 Changes and Updates
Beyond Tickets reserves the right to change, update, or discontinue the platform or parts thereof at any time. Customers have no entitlement to any specific functionality of the platform.
7.6 Customer Content
7.6.1 License to Use Content
Customers who provide content (e.g., texts, images, videos, reviews) on the platform grant Beyond Tickets a simple, temporally and spatially unlimited, transferable and sublicensable usage right to use this content for the operation, marketing, and further development of the platform.
7.6.2 Ownership of Customer Content
Ownership of the content provided by customers remains with the customers, unless differing agreements are made. Customers assure that they have all necessary rights to provide the content and grant the aforementioned usage rights.
7.6.3 Impermissible Content
Customers may not make available or upload any content on the platform that (i) is illegal, offensive, discriminatory, or otherwise inappropriate, (ii) infringes the rights of third parties, particularly intellectual property rights, or (iii) contains malware or other harmful components.
7.6.4 Deletion of Content
Beyond Tickets reserves the right to remove content from customers without prior notice if it violates the AGB or applicable law.
8. Data Protection and Personal Data
8.1 Personal Data
The use of personal data is governed by Beyond Tickets' privacy policy. The current privacy policy can be found on the Beyond Tickets website.
8.2 Data Retention
Beyond Tickets is entitled to retain data collected during the use of the platform for a period of up to ten (10) years, as long as this is legally required.
8.3 Filming, Photography, and/or Audio Recordings at Events
Beyond Tickets and/or the organizers may make video, photo, and/or audio recordings at and of the events. These recordings may be published on the website, social media channels, or other communication channels of Beyond Tickets or the organizers.
By placing an order, the orderer expressly agrees that they may be part of such recordings and that these may be published within the aforementioned scope. The consent extends in particular to group recordings where the orderer is not highlighted as an individual.
9. Final Provisions
9.1 Change of AGB
Beyond Tickets reserves the right to change these AGB at any time. Changes will be published on the Beyond Tickets website or in the Beyond Tickets app/mobile applications. The changes take effect as soon as they are published on the website and/or in the app/mobile applications.
9.2 Set-off of Claims
Customers waive the right to set off claims against Beyond Tickets.
9.3 Severability Clause
If any provision of these AGB or any part thereof becomes invalid or unenforceable at any time, the validity or enforceability of the remaining provisions or remaining part of the provision shall not be affected or impaired in any way.
The invalid or unenforceable provision or part shall be replaced by a valid or enforceable provision that most closely corresponds to the original intent and achieves the same economic result as far as possible. The same applies in the event of gaps.
9.4 Governing Language
If versions of the AGB in different languages contradict each other, the German version of the AGB shall always prevail.
9.5 Applicable Law
These AGB and any disputes arising from or in connection with a contractual relationship between Beyond Tickets and the customer are subject in every respect to Swiss substantive law, excluding its conflict of law provisions and international treaties (in particular the UN Sales Convention).
9.6 Jurisdiction
For disputes arising from or in connection with these AGB, the ordinary courts at the registered office of the company shall have exclusive jurisdiction, unless mandatory statutory jurisdictions are provided.
