Beyond Tickets AG – General Terms and Conditions
1. General Provisions
1.1 Subject and Definitions
Beyond Tickets AG (Beyond Tickets) operates an online intermediary platform for events, which is accessible via web-based applications, mobile apps, and other digital applications (Platform). On the Platform, tickets for events of all kinds can be sold and purchased, and various types of services can be offered and booked.
The following definitions apply:
Organizers are natural or legal persons who offer tickets for events, concerts, or similar occasions on the Platform, either for a fee or free of charge (Tickets). This includes, in particular, hosting partners. Organizers act exclusively in their own name, on their own account, and at their own risk.
Events are all occurrences offered by Organizers on the Platform, either for a fee or free of charge, for which tickets can be purchased. These include, in particular, events, concerts, festivals, performances, and similar activities.
Service Providers are natural or legal persons who offer various services on the Platform, either for a fee or free of charge. Service Providers act exclusively in their own name, on their own account, and at their own risk.
Services include all offerings provided by Service Providers that can be booked via the Platform, either for a fee or free of charge. These include various types of services and goods.
Purchasers are natural or legal persons who purchase or book tickets or services via the Platform, either for a fee or free of charge. If a Purchaser acquires multiple tickets, all natural or legal persons receiving a ticket from the Purchaser are also considered Purchasers.
Orders refer to the process of acquiring tickets or booking services, either for a fee or free of charge, by Purchasers.
Customers include Organizers, Service Providers, and Purchasers. Customers require an individual platform account (Account) to use the Platform.
1.2 Beyond Tickets as an Intermediary Only
Beyond Tickets is – unless expressly agreed otherwise and/or indicated – never itself the Organizer, Service Provider, or Purchaser of the events or services offered on the Platform. Beyond Tickets acts solely as the operator of the Platform and generates tickets on behalf of the Organizers.
The responsibility for services related to tickets and services offered via the Platform, as well as the orders, lies solely with the respective Organizer and/or Service Provider. Organizers and Service Providers always act in their own name, on their own account, and at their own risk when using the Platform. They are solely responsible for conducting events or providing services.
1.3 Scope of the GTC and Other General Terms and Conditions
The General Terms and Conditions of Beyond Tickets (GTC) apply exclusively to any use and type of usage of the Platform by Customers.
The GTC form an integral part of the contract between Beyond Tickets and the respective Customer.
Chapters 1 and 6 to 9 of these GTC apply to all Customers. Additionally, Chapter 2 applies to Purchasers, Chapters 3 and 5 apply to Organizers, and Chapters 4 and 5 apply to Service Providers.
If Organizers and Service Providers have their own General Terms and Conditions, which apply specifically to the execution and attendance of events or the provision of services, these terms apply in addition to the present GTC of Beyond Tickets.
In contractual relationships between Purchasers on the one hand and Organizers or Service Providers on the other, the General Terms and Conditions of the Organizers and Service Providers take precedence over the GTC of Beyond Tickets in case of conflict. Purchasers are responsible for informing themselves about and complying with the applicable General Terms and Conditions of the respective Organizer or Service Provider. Violations of these General Terms and Conditions may result in denial of entry or exclusion from the event without any right to refund or compensation.
Beyond Tickets assumes no liability for the content, requirements, or consequences arising from the General Terms and Conditions of the Organizer, the event venue, or the Service Provider. The General Terms and Conditions of Organizers and Service Providers do not apply to Beyond Tickets under any circumstances; only the GTC of Beyond Tickets are binding.
1.4 Place of Performance
The place of performance for all services provided by Beyond Tickets, including the generation of tickets, is the registered office of Beyond Tickets.
1.5 Communication by Beyond Tickets
Beyond Tickets primarily communicates electronically via email.
1.6 Accuracy of Customer Data
Customers are required to provide accurate and up-to-date information, including a valid email address where notifications from Beyond Tickets can be received. Customers are solely responsible for receiving and acknowledging notifications sent by Beyond Tickets to the email address they provide.
1.7 Responsibility for Electronic Devices Used by Customers
Customers are solely responsible for ensuring that the electronic devices they use are operational and have all necessary software updates installed. This applies in particular to the display of tickets by Purchasers as well as the verification of tickets by Organizers at the entrance to an event.
1.8 Maintenance and Support
Beyond Tickets reserves the right to take the Platform or parts of it offline at any time for maintenance, improvements, or technical adjustments. Planned maintenance work will be announced in advance on the Platform and/or within accounts whenever possible.
Beyond Tickets provides support services for the Platform to the extent that Beyond Tickets deems appropriate and necessary. There is no entitlement to a specific type, scope, or response time of support unless expressly agreed in writing.
Beyond Tickets is not liable for damages resulting from the temporary unavailability of the Platform, delays in support, or technical disruptions.
1.9 Violation of These GTC
Beyond Tickets reserves the right to temporarily suspend or permanently delete an account in the event of a violation of one or more provisions of these GTC, particularly Clause 2.3. Beyond Tickets is not required to provide prior notice of such sanctions.
2. Specific Provisions for Purchasers
2.1 Ordering and Use
2.1.1 Conclusion of Contract
Orders are considered completed when the Purchaser receives a corresponding confirmation (acceptance) of the order from Beyond Tickets (on behalf of and in the name of the Organizer or Service Provider).
When an order is placed, a direct contractual relationship is established between the Purchaser and the Organizer or Service Provider. The Purchaser acknowledges that such a relationship solely entails rights and obligations between the Purchaser and the Organizer or Service Provider. Rights and obligations between Beyond Tickets and the Purchaser arise only to the extent that the order involves direct services provided by Beyond Tickets.
2.1.2 Fees and Payment
In addition to the price of tickets or services, service fees, processing fees, and other event-specific charges may apply. These fees will be displayed to the Purchaser during the ordering process.
The payment methods available on the Platform during the ordering process may depend on the requirements of an Organizer or Service Provider. Beyond Tickets, Organizers, and Service Providers are not obligated to offer specific payment methods.
2.1.3 Delivery in Electronic Form
Purchased tickets are delivered exclusively as electronic tickets, known as e-tickets, in Portable Document Format (PDF) via email or another electronic form. Order confirmations for services are also sent electronically (confirmation). The ticket or confirmation is only sent to the Purchaser after payment has been completed.
The Purchaser is solely responsible for ensuring that they receive their ordered ticket(s) or confirmation and for presenting the ticket(s) at an event, particularly in the case of an entry check. This includes ensuring that the Purchaser has a functioning mobile device (e.g., smartphone) with the necessary software and security updates installed.
The Purchaser is free to print their e-ticket(s) physically. If the Purchaser presents a ticket in physical form, they must ensure that the ticket remains legible and undamaged.
2.1.4 Responsibility for Information Provided During the Ordering Process and Purchaser’s Duty to Verify
The Purchaser bears the risk of correctly providing information during the ordering process, particularly regarding the selection of the service or event, location, date, and seat. In the case of personalized tickets as per Clause 2.1.7, the Purchaser is responsible for providing accurate details and information for all individuals for whom they are purchasing tickets.
The Purchaser is required to verify the order immediately upon receipt. Specifically, for personalized tickets as per Clause 2.1.7, the Purchaser must check whether the names and information provided are correct. Any discrepancies or errors must be reported in writing to Beyond Tickets’ support as per Clause 2.6 without delay, but no later than five (5) business days after receipt and always before the event. If no report is made by the Purchaser within this period, Beyond Tickets will no longer be able to make any adjustments.
2.1.5 Modification or Alteration of Tickets by Purchasers
Copying, altering, or imitating tickets is strictly prohibited. Manipulated tickets will be rendered invalid, and entry to the event may be denied. Purchasers are not entitled to a refund.
2.1.6 Technical Issues and Defective Tickets
Beyond Tickets is not liable for technical issues caused by external factors such as defective mobile devices, incompatible software, or the Purchaser’s lack of internet connection.
Physically printed tickets with an unreadable barcode or otherwise damaged printed tickets will not be replaced and are considered invalid.
The Purchaser is responsible for reporting any technical issues with tickets to Beyond Tickets immediately. Upon receiving such a report, Beyond Tickets may issue a replacement ticket if the ticket order can be verified and the technical issue was not caused by improper handling or modification by the Purchaser.
2.1.7 Personalized E-Tickets and Admission Authorization for Events
Organizers are entitled to personalize tickets (Personalized Tickets). If an Organizer personalizes tickets for an event, only the person named on the respective ticket is authorized to attend the event.
It is at the sole discretion of the Organizer to require a valid proof of age from Purchasers for admission to an event. Failure to provide proof of age may result in denied entry. For personalized tickets, only the person named on the ticket will be granted entry to the event. If the information on the ticket does not match the identity of the person requesting entry, admission may be denied. This also applies if the name on the ticket is illegible. In such cases, the Purchaser is not entitled to a refund.
Purchasers are required to comply with health and safety regulations as well as all relevant security requirements set by the Organizer. This includes agreeing to entry and security checks intended to ensure the safety of all attendees. Organizers reserve the right to deny entry or remove Purchasers from the event if certain circumstances require it. Additionally, admission may be restricted or denied to Purchasers who arrive late to the event, depending on the Organizer’s policies.
2.2 Cancellation and Refunds
2.2.1 General Principle
Beyond Tickets assumes no responsibility for the execution, modification, or cancellation of events or services. Any concerns or claims directly or indirectly related to an event or service must be addressed exclusively to the respective Organizer or Service Provider.
Once an order has been completed, cancellations, returns, or refunds for an order processed through Beyond Tickets are excluded. This applies regardless of the reason preventing attendance at the event or service, such as illness, unforeseen circumstances, or other personal obstacles faced by the Purchaser. Different provisions set by Organizers or Service Providers take precedence.
Every order is subject to the Organizer’s or Service Provider’s right to modify or adjust the event schedule or program if special circumstances or events beyond their control require such changes. Such modifications do not entitle the Purchaser to an exchange, order modification, refund of the purchase price, or any other compensation.
2.2.2 Postponement or Relocation of an Event or Service
In the event of a postponement of the event/service date or a change of the event/service location, the ticket or confirmation remains valid for the new date and/or location. The Organizer or Service Provider independently decides whether refunds or rebookings are offered under such circumstances. Beyond Tickets assumes no responsibility for these decisions.
2.2.3 Cancellation of Events or Services
If an event or service must be canceled due to force majeure (e.g., natural disasters, pandemics, epidemics, government orders, etc.), the contract between the Purchaser and the Organizer or Service Provider remains in effect. The Organizer or Service Provider determines the next steps in such cases, including potential refunds or rescheduling. Beyond Tickets is not liable for financial or other damages resulting from the cancellation of an event or service due to force majeure.
If the Organizer or Service Provider decides to cancel an event or service without a replacement, the responsibility for any potential refunds lies solely with the respective Organizer or Service Provider.
2.2.4 Refunds
The refund of orders is the sole responsibility of the Organizer or Service Provider. A refund through Beyond Tickets is excluded. The Purchaser will be informed via email about the refund process and the necessary steps. Claims can only be made within the deadlines set by the Organizer or Service Provider.
If pricing errors are identified as per Clause 3.1 or 4.1, Beyond Tickets will notify affected Purchasers via email. The Purchasers will then have the option to confirm the order at the correct price or cancel it. In the event of a cancellation, the full amount will be refunded.
2.3 Transfer and Resale of Tickets Purchased via the Platform
The commercial transfer or resale of tickets is prohibited. Tickets are intended solely for the personal use of the Purchaser. A violation of this provision may result in the cancellation of the tickets without refund, compensation, or liability from Beyond Tickets.
2.4 Maximum Number of Tickets
Organizers are entitled to set a maximum number of tickets that can be purchased per Purchaser per event at their discretion. The maximum number is displayed during the ordering process.
Beyond Tickets expressly reserves the right to declare invalid and cancel tickets purchased beyond this maximum limit by the same Purchaser without prior notice. This includes tickets purchased by the same natural or legal person using different accounts on the Platform. The cancellation and invalidation of such tickets by Beyond Tickets will be carried out without refund, compensation, or liability from Beyond Tickets.
2.5 Allianz Ticket Protection
Purchasers may have the option to purchase Allianz Assistance Ticket Protection as an additional product during the ticket purchasing process for an event. The Ticket Protection covers various risks in accordance with the General Insurance Conditions (AVB) of the Ticket Protection policy.
The Ticket Protection is offered directly and exclusively by Allianz (AWP P&C S.A., Saint-Ouen (Paris), Branch Office Wallisellen, Switzerland). Beyond Tickets acts solely as an intermediary for this optional add-on product and assumes no liability or responsibility for claims related to or arising from the Ticket Protection. The applicable General Insurance Conditions of Allianz, which will be displayed during the checkout process when purchasing the Ticket Protection, apply.
Claims must be directed to Allianz at claims.ch@allianz.com.
2.6 Purchaser Inquiries
Purchaser inquiries regarding the Platform must be submitted exclusively to Beyond Tickets via email at support@beyond-tickets.com. Inquiries will be answered within a reasonable timeframe.
For inquiries regarding the event or service itself, the Purchaser must contact the respective Organizer or Service Provider directly. Beyond Tickets does not respond to inquiries that should be directed to an Organizer or Service Provider.
3. Specific Provisions for Organizers
3.1 Conclusion of Contract
The contract between the Organizer and Beyond Tickets is formed when the Organizer receives a corresponding confirmation (acceptance) from Beyond Tickets after publishing an event on the Platform.
The contract between the Organizer and the respective Purchaser is formed when the Purchaser receives a corresponding confirmation (acceptance) of the order from Beyond Tickets (on behalf of and in the name of the Organizer). When an order is placed, a direct contractual relationship is established between the Purchaser and the Organizer. Beyond Tickets is not part of this contractual relationship and acts solely as an intermediary for the Organizer’s services.
3.2 Fees and Refunds
The fee per ticket ordered for an event is CHF 1.00 plus 5% of the ticket price (Service Fee). Individual agreements between Organizers and Beyond Tickets remain reserved. The Service Fee is added to the purchase price and is borne by the ticket buyers.
Beyond Tickets is under no circumstances obligated to refund Service Fees. A refund due to postponement or relocation as per Clause 2.2.2, if approved by the Organizer, will be issued only for the net event price. The Service Fee is excluded from the refund and remains with Beyond Tickets.
3.3 Advertising and Content on Tickets
The Organizer bears full and sole responsibility for the content printed on the generated tickets, whether provided by the Organizer or added at their request. Beyond Tickets assumes no liability for the accuracy or completeness of this content.
Organizers agree to fully indemnify Beyond Tickets against any damages arising from ticket content for which the Organizer is responsible. The same applies to advertisements printed on the tickets by the Organizer.
3.4 Fair Use Policy for Free Tickets
Organizers may generate free tickets (Free Tickets) for events within a reasonable scope. The number of Free Tickets that can be generated is limited to 1,000 Free Tickets per Organizer per calendar year. Individual agreements between an Organizer and Beyond Tickets remain reserved.
The generation of Free Tickets is excluded from the maintenance and support services outlined in Clause 1.8.
Beyond Tickets reserves the right to restrict or suspend an Organizer's account if Free Tickets are generated in an excessive or inappropriate manner. If the Organizer exceeds the limit set in this clause, Beyond Tickets may charge an additional fee of CHF 0.20 per ticket created beyond the limit.
3.5 Test Tickets
Beyond Tickets has the right to generate up to two (2) test tickets per event free of charge for the purpose of software verification and process validation, provided that the maximum available number of tickets for the event is not exceeded.
3.6 Entry Management at an Event
Beyond Tickets provides the scanning software required for event entry management. Beyond Tickets and an Organizer may enter into additional individual agreements regarding further services related to personnel and technology.
Beyond Tickets is not liable for technical issues caused by external factors such as defective mobile devices, incompatible software, or the lack of an internet connection.
Organizers are required to report any technical issues with tickets, QR codes, or other digital admission credentials to Beyond Tickets without delay.
4. Specific Provisions for Service Providers
4.1 Conclusion of Contract
The contract between the Service Provider and Beyond Tickets is formed when the Service Provider receives a corresponding confirmation (acceptance) from Beyond Tickets after publishing a service on the Platform.
The contract between the Service Provider and the respective Purchaser is formed when the Purchaser receives a corresponding confirmation (acceptance) of the order from Beyond Tickets (on behalf of and in the name of the Service Provider). When an order is placed, a direct contractual relationship is established between the Purchaser and the Service Provider. Beyond Tickets is not part of this contractual relationship and acts solely as an intermediary for the Service Provider’s services.
4.2 Fees and Refunds
The fee per booking of a ticket or service is a base fee of CHF 1.- per ticket plus 5% of the sale price (Service Provider Fee). Individual agreements between Service Providers and Beyond Tickets remain reserved.
Beyond Tickets is under no circumstances obligated to refund the Service Provider Fees. A refund due to postponement or relocation as per Clause 2.2.2, if approved by the Service Provider, will be issued only for the net service price. The Service Provider Fee is excluded from the refund and remains with Beyond Tickets.
4.3 Responsibility for Accurate Information
Service Providers bear sole responsibility for and in connection with the services they offer. Beyond Tickets does not guarantee the accuracy or completeness of the information communicated by Service Providers.
Service Providers are solely responsible for any damages incurred by Beyond Tickets as a result of incorrect or incomplete information regarding their services.
5. Common Provisions for Organizers and Service Providers
5.1 Operation of the Platform
Beyond Tickets provides Organizers and Service Providers with access to the Platform and its associated services, including remote access, in accordance with industry standards, striving for optimal availability and accessibility. However, Beyond Tickets does not guarantee uninterrupted availability of the Platform or its associated services. Beyond Tickets reserves the right to temporarily restrict access to the Platform if necessary.
5.2 Use of the Platform
By using the Platform, Organizers and Service Providers acknowledge that Beyond Tickets provides no guarantees of any kind, including but not limited to the uninterrupted availability of the Platform, merchantability, suitability for a particular purpose, or freedom from errors or failures.
5.3 Communication by Beyond Tickets and Access to Information
Invoices, reports, and other communications between Beyond Tickets and Organizers or Service Providers are conducted electronically via email or digitally through the Platform.
As long as their account remains active, Organizers and Service Providers have access to information regarding the status of their events. Beyond Tickets allows Organizers and Service Providers to download stored customer data for up to thirty (30) calendar days after an Organizer or Service Provider has deleted their account or their account has been suspended or deleted by Beyond Tickets. After this period, Beyond Tickets may permanently delete the account.
5.4 Responsibility for Events and Services
Organizers and Service Providers bear sole responsibility for and in connection with the execution of an event or service, as well as for the legality, accuracy, completeness, and timeliness of the information and materials they make available or communicate to Purchasers and/or Beyond Tickets.
Beyond Tickets does not guarantee the accuracy or completeness of information made available by Organizers and Service Providers on the Platform. Organizers and Service Providers are exclusively responsible for this information.
Organizers and Service Providers bear sole responsibility for any damages incurred by Beyond Tickets due to incorrect or incomplete information regarding events or services.
Organizers and Service Providers are solely responsible for handling value-added tax (VAT) reporting.
5.5 Revocation of Platform Usage Rights
Beyond Tickets is entitled to immediately prohibit an Organizer or Service Provider from using the Platform if Beyond Tickets has reasonable grounds to believe that the affected Organizer or Service Provider is issuing instructions that cannot be executed. Beyond Tickets is not required to provide prior notice of this action.
5.6 Inquiries from Organizers and Service Providers
Inquiries from Organizers and Service Providers regarding the Platform must be submitted exclusively via email to support@beyond-tickets.com. Inquiries will be answered within a reasonable timeframe.
5.7 Marketing Tracking
Beyond Tickets offers Organizers and Service Providers support in setting up marketing tracking (e.g., pixel tracking) for an additional fee.
6. Liability
Beyond Tickets is not liable for minor or moderate negligence, including any indirect damages resulting from such negligence.
Beyond Tickets solely operates the Platform and assumes no liability for any losses, damages, or injuries of any kind that occur before, during, after, or otherwise in connection with an event and/or service. This includes, but is not limited to, loss, damage, or theft of personal belongings. Events and services are the sole responsibility of the respective Organizer or Service Provider.
7. Intellectual Property and Other Rights
7.1 Rights to the Platform
All rights, titles, and claims to the Platform, including but not limited to the underlying software, source code, design, content, trademarks, logos, texts, images, databases, and other elements, remain the exclusive property of Beyond Tickets or its licensors. This includes all intellectual property rights, including copyrights, trademark rights, patent rights, and design rights.
7.2 Granting of Usage Rights
Customers are granted a limited, non-exclusive, non-transferable, non-sublicensable, and revocable right to use the Platform in accordance with these GTC and solely for its intended purposes.
7.3 Prohibited Actions
Customers are prohibited from, without prior written consent from Beyond Tickets:
(i) copying, modifying, adapting, reverse engineering, decompiling, or otherwise attempting to decipher the source code of the Platform, except as permitted by mandatory Swiss law,
(ii) using the Platform for unlawful purposes or in a manner that infringes the rights of Beyond Tickets or third parties, or
(iii) using automated systems (e.g., bots, scraping tools) to access the Platform or extract content.
7.4 Protection of Rights
Customers acknowledge that the Platform is protected by copyright, trademark law, patent law, and other protective rights under Swiss law. Any unauthorized use, distribution, or infringement of these rights is prohibited and may result in civil and criminal consequences.
7.5 Changes and Updates
Beyond Tickets reserves the right to modify, update, or discontinue the Platform or parts thereof at any time. Customers have no entitlement to specific functionalities of the Platform.
7.6 Customer Content
7.6.1 License to Use Customer Content
Customers who provide content (e.g., texts, images, videos, reviews) on the Platform grant Beyond Tickets a simple, perpetual, worldwide, transferable, and sublicensable right to use such content for the operation, marketing, and further development of the Platform.
7.6.2 Ownership of Customer Content
Ownership of the content provided by Customers remains with the Customers unless otherwise agreed. However, Customers confirm that they hold all necessary rights to provide the content and to grant the aforementioned usage rights.
7.6.3 Prohibited Content
Customers may not upload or make available any content on the Platform that:
(i) is illegal, offensive, discriminatory, or otherwise inappropriate,
(ii) infringes the rights of third parties, particularly intellectual property rights, or
(iii) contains malware or other harmful components.
7.6.4 Deletion of Content
Beyond Tickets reserves the right to remove Customer content without prior notice if it violates these GTC or applicable law.
8. Data Protection and Personal Data
8.1 Personal Data
The use of personal data is governed by the Beyond Tickets Privacy Policy. The latest version of the Privacy Policy can be found on the Beyond Tickets website.
8.2 Data Retention
Beyond Tickets is entitled to retain data collected during the use of the Platform for up to ten (10) years, insofar as this is legally required.
8.3 Video, Photo, and/or Audio Recordings at Events
Beyond Tickets and/or the Organizers may record video, photo, and/or audio material at events. These recordings may be published on the website, social media channels, or other communication platforms of Beyond Tickets or the respective Organizers.
By placing an order, the Purchaser expressly agrees that they may be included in such recordings and that these may be published as outlined above. This consent particularly applies to group recordings where the Purchaser is not individually highlighted.
9. Final Provisions
9.1 Amendments to the GTC
Beyond Tickets reserves the right to amend these GTC at any time. Changes will be published on the Beyond Tickets website or within the Beyond Tickets app/mobile applications. The changes take effect as soon as they are published on the website and/or in the app/mobile applications.
9.2 Offsetting of Claims
Customers waive the right to offset any claims against Beyond Tickets.
9.3 Severability Clause
If any provision of these GTC or part thereof is or becomes invalid or unenforceable at any time, the validity and enforceability of the remaining provisions or the remaining part of the provision shall not be affected in any way.
The invalid or unenforceable provision or part thereof shall be replaced by a valid and enforceable provision that most closely reflects the original intent and achieves, as far as possible, the same economic result. The same applies in the event of any gaps in the GTC.
9.4 Governing Language
In the event of discrepancies between different language versions of these GTC, the German version shall prevail.
9.5 Applicable Law
These GTC and all disputes arising from or in connection with a contractual relationship between Beyond Tickets and the Customer are governed in all respects by Swiss substantive law, excluding its conflict-of-law provisions and international treaties (particularly the UN Convention on Contracts for the International Sale of Goods).
9.6 Jurisdiction
For disputes arising from or in connection with these GTC, the ordinary courts at the registered office of the company shall have exclusive jurisdiction, unless mandatory statutory jurisdictions are provided.
