Terms and Conditions for Importing Customer Lists
Lawful collection and use
If, as an organizer, you use the CRM functions of Beyond Tickets and import your own customer lists (e.g., names, email addresses, telephone numbers) into the platform, you expressly warrant that you have all necessary rights, consents, and a lawful basis to upload these data and use them for marketing and communications purposes. This applies in accordance with the applicable data protection legislation, in particular the Swiss Federal Act on Data Protection (nDSG) and the European General Data Protection Regulation (GDPR).
Opt-outs and withdrawals
You guarantee that the uploaded lists do not contain records of persons who have exercised their right to object to data processing or to receiving marketing communications. Should a data subject object to receiving communications or request deletion of their data after the upload, you are obliged to implement this immediately in your Beyond Tickets CRM.
Exclusion of sensitive data
You assure that the imported customer lists do not contain, either directly or indirectly, particularly sensitive personal data (in accordance with Art. 5 lit. c nDSG and Art. 9 GDPR). This includes, among other things, health data, biometric or genetic data, information about ethnic origin, political opinions, religious beliefs, as well as information about minors under 16 years of age.
Allocation of roles and data processing agreement (DPA)
In the course of processing these uploaded customer lists, you act under data protection law as the “controller”. Beyond Tickets acts as an instructed “processor” (within the meaning of Art. 9 nDSG) or “data processor” (within the meaning of Art. 28 GDPR). Beyond Tickets uses this data exclusively to provide the CRM and platform services for you. Beyond Tickets will never disclose, sell, or use these specific customer lists for its own purposes. By uploading the data, you confirm the conclusion of our data processing agreement (DPA), which forms part of our terms and conditions.
Indemnification
You fully indemnify Beyond Tickets against any claims, demands, regulatory fines, or costs of third parties arising from unlawful collection, use, or unlawful import of customer data by you as the organizer.
